Multimillionaire calls CRA negligent, wants $4.8M tax bill thrown out
The payment of this amount for Charles Shaker, 44 years old, may depend on the efficiency of the Canada Revenue Agency (CRA) department. According to court records, in March 2017, an auditor concluded that the former resident of the Ottawa area owed an additional $3.8 million in taxes for the years 2008 and 2009. This was based on calculations that uncovered millions of dollars in unreported personal benefits, such as car payments and expenses from a consulting and financial planning company that he owned.
With penalties and interest, this debt has increased to $4.8 million. However, in addition to the discrepancies in these numbers, Shaker claims that the CRA has missed a crucial step: properly informing him of a reassessment or not providing any indication of the amount he is required to pay.
He has put the amount in dispute before the Tax Court and is requesting an arbitrator to settle it. His lawyers wrote in a separate but related lawsuit last year, "CRA has not provided any evidence that it has issued any notice regarding the tax debt to Mr. Shaker." "CRA is obligated to provide a proper notice to the debtor... Consequently, there is no valid tax debt owed by Mr. Shaker to date."
